Q: Do I need an attorney for probate or trust administration?
Georgia law does not require you to have an attorney for probate or trust administration. However, it is often a good idea to seek legal counsel. Although the probate court does not require you to have an attorney, the probate clerks are not allowed to give you legal advice. We often find that when people attempt to file for probate on their own, errors are made, which end up costing more time and money than would have been requried if an attorney had been hired in the first place. Our promise to all clients is that all fees are agreed to in advance, and we attempt to work on a flat fee basis as much as physically possible.
